The action, linkage and legality of government procurement, for local development and social economy effectors, has a legal and technical support, which positioned it among the most advanced legislations in these issues in Latin America, The characteristics of the legal functionality and its introduction within the regulatory decrees of state procurement (Decree No. 1023/01 and Decree No. 1030/16), gave it a legal support beyond the economic, adding a social function, especially for these sectors that are disadvantaged when competing against large companies in a microeconomic environment of disadvantage and vulnerability. The demands that arise within the system are reflected in the inverted pyramid, which applied to this case, could elucidate this need from the local level and translate it into a national environment. For this reason, this paper attempts to reflect the regulations, the need and its real application based on studies and experiences of state purchases.
