It was carried out as a descriptive, qualitative research and a case study design was utilized. Data was collected through focus group interviews. There were three categories of focus groups which were interviewed, namely, learners; teachers and principals and school drop outs. Three primary schools within Amathole District were used in the study. Three step data analysis process suggested by Steinberg was utilized as outlined in the study. The study found out that the right to education is enriched and protected in a number of human rights instruments nationally, regionally and internationally. Apart from being protected in the Constitution, the right to education is also guaranteed in a number of other laws and policies in South Africa.
