This paper focuses on the analysis of important features of the bankruptcy system in the US and Brazilian system of law, on a comparative perspective. The automatic stay and the new Brazilian theories will be analyzed in the lights of the comparative law. It has as a goal to raise issues and discussions about important aspects of the automatic stay in the context of both systems of law.
