This is a comprehensive research work that covers almost all forms of unfair discrimination practices and further compare and contrast these unfair discrimination practices with the ones from South Africa, Canada, United Kingdom and United State of America. The background study as to shed unique history of each country which consequently shaped their current employment relations is explored. This paper introduces itself by looking at the above-mentioned countries constitution and their pieces of labor legislation. Furthermore it assessing fairness and justice by giving previous judgements ( Case Laws) with regard to consistency in terms of law application in Judicial institutions and jurisdictional disputes resolution bodies of all these selected countries. Ultimately this paper sheds pros and cons of each country's constitution, judicial system and their labour legislation then pinpoints recommendations to South African constitution and their labour legislation.
