The South African mining industry is the cornerstone of the South African economy. With the democratisation of South Africa, the Government adopted Black Economic Empowerment to redress past injustices. To achieve transformation the Government implemented legislation which has a significant impact on the mining industry, especially the Codes of Good Practice of the Department of Trade and Industry and the Mining Charter promulgated by the Department of Minerals and Energy, which are not aligned. The Mining Charter is legally binding on the mining industry whereas the Codes of Good Practice is applicable to all other industries and the state when making decisions regarding procurement and granting of licences. Therefore the Codes of Good Practice has an indirect impact on the mining industry as a supplier of products to state and reliance on the state for the granting of licences. Mining companies will have to comply with both the Codes of Good Practice and the Mining Charter to remain competitive and operational. A single performance measurement instrument was required and the Composite Scorecard was developed.
