This is the question that aroused our interest, and which led us to analyze the positive law on copyright. It emerges from this analysis that there are shortcomings both in the normative mechanisms and in the implementation of the protection of this right. This finding raises doubts about the effectiveness of copyright protection mechanisms in the OAPI area. Because despite the existence of these protective mechanisms, we continue to witness the phenomenon of counterfeiting which, obviously, constitutes a danger for the authors of works of the mind and a threat to cultural development. The purpose of this study was therefore to demonstrate that in view of the shortcomings observed in the protection of authors' rights, it is necessary to make improvements both at the normative and jurisdictional levels. Thus, the objective of the study was to achieve better copyright protection by making proposals to improve existing mechanisms.

Der in Didiévi geborene Firmin Kouadio ist Schriftsteller und Jurist und hat einen Forschungsmaster 2 in Privatrecht.
