The purpose of this research is to explain the benefit of Punishability, based on the Ius Naturalist Theory, from the study of the most important crimes, this study shares the conception of Law as conduct, and it is developed from the Venezuelan reality, in the application of Criminal Law, in the meantime a detailed analysis of the different currents of the Legal Sciences is made, including a historical review of the phenomenon. Using the paradigm of the Hermeneutic Phenomenological Philosophy, in this descriptive, qualitative research, from the ontics of the Venezuelan phenomenon with its numerous violent deaths, unpunished, within the penitentiary units of both processed and convicted, trying to give meaning to Criminal Law and examining the international connotation of International Criminal Law.
