Article 13(5) of the Constitution of the Russian Federation stipulates that the establishment and activities of public associations whose goals or actions are aimed at a violent change of the foundations of the constitutional system and violation of the integrity of the Russian Federation, at undermining the security of the state, at creating armed units, at inciting social, racial, national and religious discord shall be prohibited. This provision of the Constitution of the Russian Federation is reflected in article 282.2 of the Criminal Code, which refers to the establishment of an organization or association in respect of which there is an enforceable court decision to dissolve it or to ban its activities on the grounds that it is extremist. In other words, in such cases we are talking about intentional non-compliance with the court decision and continuation of the unlawful activities of the banned organization in contradiction to the legitimate court decision. This norm is special.
