Using various examples, the author examines the essential institutions and foundations of the democratic, constitutional state and the ways in which it is endangered. In spite of the differing developments in individual countries constituionalism and democracy are based on one uniform theory. The emphasis on the protection of freedom by the separation of powers and the protection of human rights resulted from the emergence of the constitutional state in its struggle against the monarchic absolutism.
