The third party is the one who intervenes in the judicial process, but when he is admitted to the process, he ceases to be a third party and becomes a party to the process, because of some interest or right in the objective claim of the process, we can say that a third party is the one who is not a party. This means that a third party, for the purposes of the process, will be that person who does not sue (who has not filed the claim) or who has not been sued (who does not have to oppose the claim of the plaintiff).
