The relationship between the environment and the activities of the mining industry in Mozambique is regulated by specific legislation such as Decree 26/2004 of August 20, the Environmental Regulation for Mining Activities, the Basic Environmental Management Standards for Mining Activities approved by Ministerial Diploma 189/2006 especially dedicated to Level 1 mining activities, as well as by general environmental legislation (the Framework Law on the Environment - 20/9). In other words, Level 1 mining activities must comply with the basic environmental management standards; Level 2 mining activities the Mining Law (Law 14/2002, of June 26), Article 37, number 1 and the Environmental Regulation for Mining Activities (Decree 26/2004, of August 20), Article 1, numbers 1, 2 and 3. Although the Environmental Regulation for Mining Activities does not stipulate that Level 1 and Level 2 activities must apply for a license, it is to be assumed that all activities that could result in some environmental damage must undergo a pre-assessment.
