It is with great pleasure that I share my master's thesis, which deals with freedom of demonstration and assembly: the fine line between the exercise of a right and its abuse. In this work I defined what were then called "fundamental rights". Within the topic of fundamental rights, studies are deepened on two specific fundamental rights, the right of assembly and manifestation, facing the relevance that the principle of prohibition of the retrogression of fundamental rights, or simply its cliquet effect, enjoys in the legal environment. We also discuss the possibility of mitigating a fundamental right, at which point we go deeper into the matter by discussing the theory of "limits of limits" and the theory of "socially acceptable". Finally, the tenuous line between the exercise and the abuse of the right of assembly and manifestation is discussed, and at the end of the present work, basic premises are outlined for the operators of the right, so that they may feel more comfortable when faced with the subject discussed herein.
