This book addresses the normative and factual requirements prescribed by Law 1448 of 2011, to analyze the legal figure of opposition, presented by those who intend to assert the rights subsequently acquired over the lands claimed in said process and the correlative requirement to prove a behavior adjusted to the standard of good faith exempt from guilt as a presupposition to obtain economic compensation; in contrast to a reality of deficit of protection to vulnerable and legitimate secondary occupants, who have not surpassed said parameter set forth by the law, for whom the judgment constitutes an unacceptable injury to constitutional mandates that protect them. Faced with this reality, initially not foreseen by the Law, it has been the jurisprudence of the highest Constitutional Court that, in consideration of the rights of those affected by the restitution order, has raised guiding criteria of judicial hermeneutics, which, together with the argumentative method proposed in thisbook, will lead to justify the decision to be adopted in this regard.
