Article 7 (1) of the African Charter on Human and Peoples' Rights provides that "everyone has the right to have his case heard. This right includes: the right to bring before the competent national courts any act violating the fundamental rights recognised and guaranteed by conventions, laws, regulations and customs in force; the right to be presumed innocent until proven guilty by a competent court; the right to a defence, including the right to be assisted by a lawyer of one's choice...".
