The research analyses the history of legislation and current regulations on the subject, explores the parameters for weighing up values in relation to the conflict between the right to life and the right to liberty, examines the network of out-of-hospital treatment that enables the subsidiarity of hospitalisation and addresses the issue of the human dignity of hospitalised patients and respect for their fundamental rights in places of treatment.
