Migration understood as an iusnaturalist or iuspositivist phenomenon is the object of study and unit of analysis of the neoinstitutional approach. The approach that defines human rights as inalienable assumes that migratory flows are subject to the laws that govern residents. In this sense, it is assumed that the customs and habits of migrants can coexist with the traditions of the locals as long as they are circumscribed by the essence of human values such as freedom and equity.
