Public property can be defined as a type of property right allowing the public to use the thing but, by definition, it is not an exclusive right as each citizen must share this right with others who are equally entitled. The notion of "public property" also involves the role of the State as the representative of the public interests to administer the property on behalf of the public and prevent over exploitation. Today, the importance of public property and national wealth is also illustrated in international conventions. Public property, in Iran, is threatened by illegal activities because of ambiguity, confusion and weaknesses in Iranian laws. A lack of a comprehensive scheme and policy concerning the appropriate mechanisms of public property protection has forced the author to examine a broad area of laws. This book is the result of a PhD thesis carried out in university of Aberdeen in UK. It examines the Iranian property law system with its Islamic concepts and mechanisms forprotection of public property within the law system through comparative study with other legal systems particularly with UK and Scots law.
