In recent years, a specific problem has become evident in our country and in the world that affects women in the context of the gynecological-obstetric care they receive in both the public and private health systems, derived from gender violence, and which is known as obstetric violence. As a result of this, several countries have elaborated general laws focused on this matter, which aim to consecrate and protect the fundamental guarantees of women in their gynecological-obstetric care. The present work, will approach the legal treatment that diverse legislations have given to the Obstetric Violence, putting special emphasis on the Chilean legislation, in order to verify if this one manages to assure and to safeguard the fundamental guarantees of the women in this matter, or on the contrary, it is necessary the modification of our present system in order to protect in an adequate way these rights.
