The aim of this paper is to analyse the application of migrants' human rights and the migration policies established by the Brazilian state in comparison with legal instruments protecting foreigners at international level. To this end, a review was made of legal institutes for the protection of migrants at international level, including a study of Advisory Opinions before the Inter-American Court of Human Rights, observing the concern of nations in the commitment to respect fundamental rights, establishing a comparison with the policies implemented by the Brazilian State and their verification in practice, with regard to the application of the norm in guaranteeing human rights. We also observed the importance of states establishing migration policies in line with international legal orders regarding the rights of migrants, in order to seek a balance in the creation of a universal order, marked by equal rights for nationals and foreigners.
