Article 10 of the ICCPR and Articles 39 to 44 of Ordinance No. 344 on the prison regime organize the system of housing prisoners according to the principle of separation of prisoners, which requires that convicts be separated from accused persons, civilians from soldiers, and first-time offenders from repeat offenders. To this end, the ineffectiveness of this principle is observed in the system of accommodation of prisoners within the penitentiary institutions in the DRC in general and in particular within the central prison of Bukavu. It should be noted that the failure to observe the principle of separation of detainees in the central prison of Bukavu is due to overcrowding resulting from the inadequacy of prison facilities, but also from the excessive use of successive pre-trial detention, the absence of a military prison in South Kivu and the lack of state support for the Congolese prison system.
