The Uniform Act on Contracts for the Carriage of Goods by Road defines this contract as the one by which a natural or legal person, the carrier, undertakes principally and for remuneration, to move by road, from one place to another and by means of a vehicle, the goods which are handed over to him by another person called the consignor. This act regulates the performance of the contract, the obligations of the carrier, as well as the claims and actions that may arise from the transport contract. Today, the considerable growth of international trade that has marked the post-independence period in Africa has had an impact on the development of international road transport of goods. Thus, it was essential to regulate in a uniform manner the conditions of international road transport of goods. The Uniform Act also contains provisions relating to combined and successive transport. Finally, the final provisions determine the mandatory nature of this Act, the modalities of accession anddenunciation, and its entry into force.This OHADA Code of the Carriage of Goods by Road explains and comments, in clear and limpid language, the provisions of the Uniform Act on the Contract for the Carriage of Goods by Road.
