After graduating from The Collegiate School, he entered college and received his bachelor's degree from Dartmouth College in 1972 and his law degree from Boston College Law School in 1978. He worked under David Souter as Assistant Attorney General of New Hampshire from 1979 to 1982. During this term, he prosecuted the first white-collar crime case in New Hampshire to result in incarceration for the offenders. Hodes has been a performer and patron of the arts and entertainment community since his Dartmouth years; in the 1990s he was a leader in the creation of the Capitol Center for the Arts, and he serves on the New Hampshire State Council on the Arts.
