There is rapid growth of electronic banking due to the development of ICT in banking sectors. The development of ICT in financial industry has stirred the increase of cybercrimes in the world including Tanzania. There are national and global efforts aimed at fighting cybercrimes through enactment of cyber laws to create enabling environment for growth of electronic banking at the same time to protect the users. According to the literature surveyed, there are few studies conducted in Tanzania in this area of policy, law and institutional framework of electronic banking. Some of studies have been overtaken by occurrence of events, example the enactment of laws like Electronic and Postal Communication Act, 2010, Electronic Transaction Act, 2015, National Payment System Act, 2015 and Cybercrimes Act, 2015. It is emphasized that whenever, there is introduction of innovation, it should go in hand in hand with the amendment or enactment of policies and laws in order to protect the users. As found in this study, a part from having the legislations in this area, cyber crime in banking is increasing. This situation necessitates the need of amending/enacting the legislation from time.

Dr.Charles Ishengoma Kato is currently Senior State Attorney and Head of Legal Unit at President¿s Office: Public Service Remuneration Board. He was born in Misenyi District within Kagera region. He obtained Diploma in Education from Butimba Teacher¿s College in Mwanza, an LLB (Hons), LLM, MBA (OUT) and PhD from University of Dar es Salaam.
