The years 2016 and 2017 have seen the opening of collective procedures of two Congolese banks. This catastrophic situation has resulted in the Congolese banking system unavailability of depositors' assets. Bank liquidation procedures in the Democratic Republic of Congo generally take decades and depositors suffer the fate of the lack of a deposit guarantee fund. This study led us to examine the protection afforded to depositors in the French and European system. This protection, beyond the simple deposit guarantee funds, is achieved through much more protective legal texts. This is how we were led to look into the European directives and regulations, as well as other internal texts of French law to find elements that can contribute to the improvement of the Congolese banking system. We have also reviewed the treatment of the difficulties that some European banks have recently experienced in order to evaluate the effectiveness of the legal texts as well as the protection reserved for depositors.
