This paper provides an analysis of the subject of religion, looking at the fundamental rights and guarantees set out in the Constitution of the Federative Republic of Brazil, promulgated in 1988. It makes a critical analysis of the rights inherent in religious activity and the duties that are a consequence of this manifestation, as well as addressing the issue of the principle of secularism in the constitutional text and raising the problem of religious teaching in public schools, always bearing in mind the possibility of harmonising constitutional freedoms and the cohesion of society, based on democratic principles and social and human valorisation.
