This research addresses the theme of Restorative Justice, by first analyzing the aspects linked to the modern penal system, the theories justifying punishment and the moment of instability in which this system is living. (...) Next, a panorama of the transition between the crisis of the retributive system and the attempt to build a new paradigm, which is Restorative Justice, is presented, emphasizing the developments that make this model a new way of doing justice. Afterwards, some of the most relevant restorative practices today are explained, opening up space to comment on experiences in Brazil. Child and Youth Justice is also discussed as a privileged space for incorporating the restorative idea. Finally, through a systematic bibliographical review, the aim is to recognize Restorative Justice as a real possibility capable of making the principles of justice and democracy effective in the context of conflict resolution through the law, and also to promote a resignification of contemporary legal thinking.
