The development of alternative civilian service is considered in this paper as a whole in the development of democracy in Russia. Some provisions of the Federal Law are discriminatory against citizens, whose beliefs or religion are in conflict with military service. At the present time, scientists can assess the constitutional and legal mechanism for the exercise by citizens of the right to alternative civilian service, since certain issues of the organization of alternative civilian service, the referral of citizens to this service and the procedure for its performance have been studied. Special studies on the fact of citizens' alternative civilian service have not been conducted, accordingly, it is quite difficult for scientists to make a legal assessment of these facts on some issues, but nevertheless this problem is one of the most pressing in the domestic legal science. Development of theoretical foundations for implementation by citizens of the Russian Federation of the constitutional right to replace military service with alternative civilian service is of great importance due to the fact that the legislation on the procedure for alternative service is constantly being improved.
