Subcontracting is a very old activity and appeared with the beginning of the market economy as early as the Middle Ages, well before the industrial era. In the Democratic Republic of Congo, companies have been using subcontracting for a long time, but there was no special legislation regulating it until 2017. This lack of special legislation in this area has led to abuse and mistreatment of the workforce by companies.Faced with this situation, it was voted Law No. 17/001 of February 08, 2017 setting the rules applicable to subcontracting in the private sector, which came to clarify the rights and obligations of the parties to the subcontract. It also specifies that the subcontracting contract is a contract of enterprise, and that the relations between the workforce and the subcontracting company are governed by the labor code.Next to subcontracting, there are also private placement services of the workforce understood as Private Employment Agencies subject to a very different legal regime; the placement being the operation carried out in the framework of the placement service.
