Crime and punishment are elements that are the responsibility of the penitentiary institution, but they are not the only ones, otherwise it would not be possible to speak of social rehabilitation and, certainly, the link of the latter with society should not be underestimated. In the subjective development in the current socio-cultural coordinates, not exclusively, but particularly in vulnerable populations such as persons deprived of liberty, a tendency to develop a criminal personality has been observed. This research proposes to analyze the problem from a psychological, psychoanalytical and social reading. The method applied was qualitative, through interviews with professionals and people with experience in the penitentiary system, it was possible to contrast and complement the theoretical construction; in addition, the direct observation of subjects, product of the phenomena discussed, allowed to explore the issues from different perspectives and to evidence the effects of the variables investigated in the current subjective and social formations.
