Through successive and comparative analyzes in space and time, this article demonstrates that the Democratic Republic of the Congo is indeed a State threatened by disappearance as a State, by the absence of its destinies, at least until 'to Joseph KABILA, of a man determined to favor constitutional rule even to his detriment in order to create a framework favorable to a true democratic culture. Political institutions, of course, but which did not fit with the democratic spirit throughout his tenures in power. Nevertheless, since the peaceful handover between Joseph KABILA and Felix TSHISEKEDI, the Congo tries to live the perfect harmony between the institutions, the constitution, the political ideology and the holders of power. However, it is imperative to penetrate the meaning of the State, of the constitution and of power on the one hand and to examine the various constitutions known in the Congo with a view to a confrontation between the concepts and the real.
