The international and national community has for some time been concerned about the status of children in the world, given their vulnerability, their dependence on their environment and their lack of physical, intellectual and emotional maturity, all of which require special care and protection.It is with this in mind that article 649 of the Family Code states that when the paternal filiation of a child born out of wedlock has not been established, the court, at the request of the child, the child's mother or the public prosecutor, shall appoint a legal father from among the members of the child's mother's family or, failing that, a person proposed by the child's mother, in which case the legal father shall exercise all the prerogatives resulting from filiation in relation to the child.
