The study of the figure of corporal punishment and with it the particularity of the institutions of power, cannot be pigeonholed into a mere academic disposition or into a necessity imposed by arguments of an economic, political or authoritarian order. In this academic work three main aspects of the study of the punitive exercise are presented: historical development, the reform of the punitive element, its use and effects on the current normative and practical paradigm. To this end, a critical review is made of the proposals that have been subjected to a study of the phenomenon of punitive events, as well as of the criminal justice system itself and its regulations, seeking to systematize more than just theory, review and analysis, a way of providing fundamental contributions that also reveal the mistakes of an entire practical and regulatory system.
