This book aims to serve as a guide or tool for victims of human rights violations caused by multinational companies operating in the extractive sector. It will show the legal ways and means to engage the responsibility of these MNEs, but also to identify and show the different remedies that can be used by potential victims or NGOs working in the extractive sector. The foundations or underpinnings of the civil and criminal liability of MNEs, and the pitfalls that prevent or make it difficult to bring them before the courts, will be discussed here. The doctrinal controversies concerning their erection or not as a subject of international law, but also the provisions (soft law/hard law) that guarantee and safeguard human rights. The study of these provisions will then make it possible to identify the various mechanisms or remedies (jurisdictional and non-jurisdictional) available to victims of abuse, whether at the national or international level.
