Romania since 1927 is a member of the Berne Union for the Protection of Literary and Artistic Works created under the Berne Convention of 1886. In art. 2 of the Convention of 1886 it is defined the term of literary and artistic works through an enumeration whereby we meet the sermon and other works of this kind, which are protected in favor of its authors and rights holders.Through the present study we try to show that the sermon is defined as a speech delivered by a cleric in the church, who explains and comments a biblical text and give to the faithful the necessary moral guidelines, belongs to a class of oral works protected as well as written works, under the form of originality.Thus, we consider that the sermon is a work of intellectual creation which is protected both conventionally as well as legally, protection that provides respect for intellectual work and an incentive for creativity.In Romania, pursuits regarding intellectual property and copyright are numerous, but the most eloquent is the law no. 8 of 1996 on copyright and related rights which regulates the rights of authors of intellectual creations.
