Die Seenot von Flüchtlingen auf hoher See und der anthropogene Klimawandel stellen zwei der großen humanitären und politischen Herausforderungen unserer Zeit dar. Unter Bezugnahme auf die Radbruch’sche Formel wird im vorliegenden Paper der Frage nachgegangen, ob staatliches und supranationales Nichthandeln bei diesen beiden komplexen Problemen aus rechtsethischer Perspektive als extremes Unrecht eingestuft werden kann und welche ethischen Mindestanforderungen dies für Staaten und Staatengemeinschaften implizieren würde. Ich argumentiere, dass entsprechende Analysen und Diskurse eine wertvolle und differenzierte normative Orientierung bieten könnten - nicht nur für die Migrations- und Klimaschutzpolitik, sondern auch für den Gesetzgeber und den gesellschaftlichen Diskurs.
