This study has been undertaken with the purpose of enumerating and illustrating the various categories and classes of Defences and Exceptions in a suit for infringement against the rights of a patentee and shall further discuss and debate upon the reliability and plausibility of some of the most important defences and exceptions to infringement of patents. It shall conclude with certain very important findings upon the viability of each of such defence and shall discuss the pros and cons of each and the effect that each such defence shall cast upon the fate of the infringement suit. It seeks to suggest certain amendments that may be made under the Indian Patent Law, after undertaking a comparative analysis on the law in different jurisdictions, in order to better equip the alleged infringer with the defences that may be an effective shield against the patent attacks.
