Since "Every person in enemy hands must have some status under international law; he is either a prisoner of war or medical personnel as such, since nobody in enemy's hands can be outside the law." It is axiomatic that the Syrian armed conflict has various feature of the armed conflict some of them being covered by the existing law some of which brings challenge to the existing set of rules. It is quite clear that if some of the dilemma under the international law left untouched will encourage violation of the human right during the armed confrontation, which will defeat the key aim of the set of rules that regulate armed confrontation as well as Human Rights rules. It is quite clear that not all organized armed groups in Syria fall under the category of illegal organized armed groups or terrorist, since some of the group's formation relying on the principle of Sovereignty.
