The economic and social history of the modern era gave birth to private business and witnessed its growth into an independent economical factor. There are still open questions concerning legal aspects and meaning of these businesses. This book examines the extent to which commercial law - as a special civil law of trade - registered and assimilated this phenomenon in the 19th century. The role of private business as a central concept in the commercial law system is also placed into question.In der Wirtschafts- und Sozialgeschichte der Neuzeit hat sich das Unternehmen als wirtschaftliche Einheit herausgebildet und verselbständigt. Bis heute sind Fragen seiner rechtlichen Erfassung und Bedeutung ungeklärt. Die vorliegende Schrift untersucht, inwieweit das Handelsrecht als das Sonderprivatrecht des Wirtschaftsverkehrs dieses Phänomen im 19. Jahrhundert aufgenommen und rechtlich erfaßt hat. Dabei geht es auch um die Bedeutung des Unternehmens als Zentralbegriff fürdas System des Handelsrechts.
