The present study discusses the importance of fine sentence in the criminal justice compared to the other penalties such as imprisonment and death penalty -for countries that have not yet abolished this sanction especially enlightened by the functions of criminal sanctions. In this regard, there is adopted a comparative approach whereby a series of criminal legislations of different foreign countries are referred to as far as the legal regime of fines is concerned. Consequently, there is realized a great importance of fines balanced with other sanctions considering interests of convicted; national policy of decriminalization and restorative justice as well as the decongestion of overcrowded prisons and the bailout of the public treasury.
