The work aims to establish the legal and doctrinal need to recover the legal figure of personal notification with the sentence in contrast to Art. 361-2do. paragraph of the Criminal Procedure Code modified by law 1173, which provides for the notification of the sentence to the parties in the digital citizenship notification mailbox in case of non-appearance at the hearing of reading of the sentence; in order to ensure the defense of the accused, the right of access to justice of the private prosecution and/or interested third parties, so that they can exercise an adjective action released to their criteria and, in turn, the judicial authority can ensure that such resolution is known to the litigants in full exercise, in an effective judicial protection. Sufficient grounds are established for the updating of the personal notification with the sentence in the Bolivian legislation, in order to guarantee constitutional principles, rights and guarantees and those developed by the Plurinational Constitutional Tribunal of Bolivia. It advocates the conservation of Art. 163-num.3) 2nd and 3rd paragraphs of the Code of Criminal Procedure.
